Libby Status Conference Monday

There will be a status conference Monday (pfd) in the Scooter Libby trial.

On a related note, in addition to partially granting and denying Libby's motion to compel discovery on June 2, the Court issued an order on classified information. It ruled that by June 9, the Government must turn over substitutes of these classified documents:

(1) The government shall provide to the defense by June 9, 2006, the proposed substitution recounting Valerie Plame Wilson's employment history with the Central Intelligence Agency from January 1, 2002, and thereafter.

(2) The government shall provide to the defense by June 9, 2006, the proposed substitution discussing potential damage (if any) caused by the alleged disclosure
of Valerie Plame Wilson's affiliation with the Central Intelligence Agency.

(3) The government shall, as requested, provide to the defense by June 9, 2006, the true names of three individuals whose identities were redacted from classified documents previously made available to the defense, and shall identify for the
defense the specific documents and locations within those documents where those
names should be inserted.

    What's the significance of item (3)? Most likely confirmation that Joe Wilson leaked his wife's status to impress NYTs reporters at a cocktail party.

    Four weeks ago, during the time when we reported that White House political adviser Karl Rove was indicted for crimes related to his role in the leak of covert CIA operative Valerie Plame Wilson, the grand jury empanelled in the case returned an indictment that was filed under seal in US District Court for the District of Columbia under the curious heading of Sealed vs. Sealed. As of Friday afternoon that indictment, returned by the grand jury the week of May 10th, remains under seal - more than a month after it was handed up by the grand jury. The case number is "06 cr 128." On the federal court's electronic database, "06 cr 128" is listed along with a succinct summary: "No further information is available." We have not seen the contents of the indictment "06 cr 128". But the fact that this indictment was returned by the grand jury hearing evidence in the CIA leak case on a day that Special Prosecutor Patrick Fitzgerald met with the grand jury raised a number of questions about the identity of the defendant named in the indictment, whether it relates to the leak case, and why it has been under seal for a month under the heading Sealed vs. Sealed.

    Question: Does "Provide to the Defense" also mean "make publicly available", or will this info still remain hidden from we unwashed masses?

    Boy, truthout certainly looks silly now that the news has been released - Rove will not be indicted. Looks like Fitzmas has been cancelled. I wonder what Leopold's excuse will be this time?
